Application of General Terms and Conditions of Sale
In the absence of any particular stipulation in these conditions agreed in writing between the parties,
orders are automatically subject to the general terms and conditions of sale set out below on electronic
media, regardless of any other clauses that may appear on the buyer's documents. Placing an order by this
means implies the full and unconditional acceptance of the buyer of these general terms and conditions of
sale, to the exclusion of all other documents.
Jurisdiction
In the event of disputes that may arise from the application of the general terms and conditions of sale,
the buyer and KURUBIS undertake to find an amicable solution. If no consensus can be reached, the
following provisions will apply: - for a buyer who has placed an order from Tunisia: all disputes arising
during the execution, termination, or interpretation of the contract will be subject to Tunisian law. The
competent jurisdiction would then be either the place of residence of the defendant or the place of
effective delivery of the client's order. - for a buyer who has placed an order from abroad: all disputes
arising during the execution, termination, or interpretation of the contract will be subject to the
competent jurisdictions under the directives and regulations of the European Union.
Order
We attach great importance to the information accompanying each product, however, KURUBIS cannot be held
responsible for any unintentional errors in the information published on this site. Any order is firm and
definitive. However, a corrective message can be sent to KURUBIS within 2 hours of the order being placed.
After this deadline, no modifications can be made, as the order is being shipped.
Products
The photos presented on this site are the exclusive property of KURUBIS. They may not be used or
reproduced without prior request. The products are deliverable subject to available stocks and shipped
according to the order of arrival of the orders. In case of out of stock, KURUBIS will propose an
equivalent product, the buyer is free to refuse this offer, in which case the sale of this product will
be canceled, and the buyer will benefit from refund clauses. In the case of corked wine, it will not be
possible to replace the bottle without having received the cork from the incriminated bottle.
Price
The prices of the products displayed are expressed in Dinars including VAT but excluding shipping costs
(subject to typographical and display errors). The products are sold at the rates in force on the date of
the order, the invoice will therefore be established at the price in force at the time of registration of
the order. Payment must be made in full at the time of placing the order.
Payment terms
Payment for an order can be made by check payable to KURUBIS or by bank transfer. The shipment of the
order will begin upon receipt of payment.
Reservation of ownership
KURUBIS remains the owner of all goods sold until full and effective payment of these goods.
Delivery
We strive to shorten our delivery times as much as possible. Delivery times vary depending on the type of
shipping and the delivery location. Purchased products will be delivered within an average of two (2) to
six (6) business days from the date of final order validation (receipt of full payment for the order or
bank authorization). On the same order, the ordered products will be delivered at once. Therefore, if the
order includes specific products with a particular delivery time specified on the product page, the
longest delivery time will apply as the reference for the order delivery date. KURUBIS is committed to
delivering within a maximum of thirty (30) days. If delivery cannot be made within this time frame, the
buyer will be informed as soon as possible and will have the option to cancel the order. They will benefit
from refund clauses. We cannot be held responsible for an incorrectly transmitted shipping address by the
buyer. The reshipment fees will then be at the expense of the buyer. All delivery fees related to changes
in the delivery address after the shipment of an order cannot be covered by KURUBIS; they will be directly
invoiced and covered by the customer initiating the modification. The only cases where KURUBIS agrees to
bear the return costs are:
- for a delivery that does not comply with the order
- for a return of the order following damage to the goods during transport, but only if the customary
rules have been observed.
Transportation and customary reservations
The ordered goods travel at the risk and peril of KURUBIS. The transfer of risks of loss or damage to the
products will be effective as soon as the customer or their representative signs the delivery note. It is
therefore important to check the contents and condition of the package at the time of delivery and to make
any necessary reservations as stipulated below. After signing the delivery note, KURUBIS's responsibility
cannot be engaged if customary rules have not been observed, namely: 'The
carrier's responsibility is only engaged if precise and complete reservations have been made in writing on
the copy of the waybill presented by the delivery person to receive discharge from the recipient and
confirmed to the carrier specifically named on the waybill within three days of receipt by registered
letter.'
Protection of minors
In accordance with the provisions of Article L3342-1 of the Public Health Code amended by Law No. 2009-879
of July 21, 2009, the sale of alcohol to minors under the age of eighteen (18) is prohibited.
